Terms of use, employer purchasing terms, and job-seeker rules

Acceptance and scope

These Website and Job Board Terms and Conditions (the "Terms") are a binding agreement between you and Oncology Medical Physics LLC ("OMP," "we," "us," or "our"). They govern your access to and use of oncologymedicalphysics.com, the OMP job board, OMP accounts, forms, communications, content, and related online services (collectively, the "Services").

By accessing the Services, creating an account, submitting content, applying to a job through the Services, or purchasing a listing, you agree to these Terms and the OMP Privacy Policy. If you use the Services for an organization, you represent that you have authority to bind that organization, and "you" includes the organization. If you do not agree, do not use the Services.

Some features may display additional terms at checkout or submission. Those terms form part of this agreement. If they conflict with these Terms, the feature-specific terms control for that feature, except that mandatory law always controls.

Who may use the Services

You must be at least 18 years old and legally able to enter a contract. The Services are not directed to children. You may not use the Services if doing so is prohibited by applicable law or if OMP previously suspended you for material misuse.

OMP's role

OMP provides information and technology that help job seekers and employers find one another. Unless OMP expressly signs a separate written recruiting or consulting agreement, OMP is not an employer, staffing firm, employment agency, representative, fiduciary, or party to any employment discussion or agreement between a job seeker and an employer.

OMP does not guarantee that a listing is complete or accurate, that a person or organization is who they claim to be, that an applicant is qualified, that an employer will respond, or that any interview, offer, hire, credential, compensation, immigration outcome, or employment relationship will result. Users must conduct their own diligence. OMP may use reasonable verification measures, but those measures are not an endorsement or warranty.

Accounts and account security

Browsing and searching public job listings does not require an account. A job-seeker account may be required for saved jobs, alerts, application tracking, résumé storage, or other optional features. An employer account is required to purchase, submit, manage, or renew employer listings.

Provide current and accurate information; keep credentials confidential; use a unique password; promptly update account information; and notify OMP at support@oncologymedicalphysics.com if you suspect unauthorized access. You are responsible for activity under your account unless applicable law provides otherwise. OMP may require reasonable identity, organization, or authority verification.

Job-seeker accounts, profiles, and alerts

Job seekers may create profiles, save jobs, create alerts, upload a résumé, and use other tools that OMP makes available. You control whether to use these optional features. Job alerts and service messages are transactional communications tied to the feature you requested; marketing messages require a separate choice where required by law.

Keep profile and application information accurate. Do not upload Social Security or social-insurance numbers, government identification numbers, bank or payment credentials, patient information, medical records, genetic or biometric data, or other information not reasonably necessary for a job search. Do not include sensitive personal information in a résumé unless it is genuinely necessary and lawful; accommodation information should generally be provided directly to the prospective employer through an appropriate channel.

Résumés and employer visibility

A résumé uploaded to an OMP account is private from employers by default. Uploading a résumé does not make it searchable. OMP will make it searchable or otherwise visible to verified employers only after the job seeker takes a separate affirmative action to enable employer visibility. The control must be off by default.

A job seeker may turn visibility off or delete the résumé through available account controls or by contacting privacy@oncologymedicalphysics.com. Turning visibility off prevents new employer access after OMP processes the change, but cannot retrieve copies an employer previously accessed at the job seeker's direction. Employers must follow the candidate-data restrictions in these Terms.

At launch, OMP does not sell paid access to a searchable résumé database. If OMP later offers paid or bundled database access, OMP will first update its notices, contracts, consent flows, security controls, and any legally required sale, sharing, or opt-out mechanisms.

Applications and external application sites

A listing may permit an application within the Services or link to an employer's or third party's application site. When you choose to apply within the Services, OMP transmits the application materials to the employer identified in the listing and may retain a platform copy as described in the Privacy Policy. When you leave the Services, the destination site's terms and privacy practices apply.

Each employer independently decides how to evaluate and retain applications and generally acts as an independent controller or business for applicant data it receives. Direct privacy, accommodation, hiring, or record-retention questions concerning the employer's process to that employer.

Employer accounts and authority

An employer user represents and warrants that it is authorized to act for the named organization; the organization and role are genuine; all billing and contact information is accurate; and the account will be used only for lawful recruitment. Agencies and recruiters must have authorization to advertise the role and must accurately identify the hiring organization when legally required.

OMP may request business-domain email verification, organizational records, recruiter authorization, or other reasonable evidence. OMP may delay publication while reviewing a listing or account.

Job-listing standards

Each employer-submitted listing must:

  • Describe a genuine, currently available opportunity and accurately state the employer, material duties, location or remote status, employment type, required credentials, and material conditions.
  • Comply with employment, labor, equal-opportunity, anti-discrimination, accessibility, wage-and-hour, pay-transparency, immigration, professional-licensing, advertising, and consumer-protection laws that apply to the role and recruiting process.
  • Clearly disclose any lawful applicant-paid cost, commission-only arrangement, travel burden, material contingency, or unusual compensation structure; no listing may charge a candidate merely to apply.
  • Avoid false urgency, misleading compensation, impersonation, bait-and-switch descriptions, pyramid or multi-level marketing schemes, unlawful independent-contractor classification, credential misrepresentation, or requests for unnecessary sensitive information.
  • Use content the employer has the right to provide and exclude malware, tracking code, confidential patient information, trade secrets, or third-party personal data that the employer lacks authority to disclose.
  • Provide a monitored contact or application destination and promptly update or close the listing when the role is filled, withdrawn, or materially changed.

OMP may impose category-specific requirements for medical-physics, healthcare, academic, government, or regulated roles. Publication does not mean OMP has verified licensure, accreditation, salary, benefits, sponsorship, or regulatory status.

Publicly sourced listings

OMP may create a listing from factual information that an employer has publicly posted on its own career site or another authorized public source. OMP will identify the listing as externally sourced, link to the original application source when practicable, use only the factual detail reasonably needed to help users discover the role, and may write an original summary rather than reproduce a full job description.

A sourced listing is informational and is not an endorsement, paid placement, or representation that the employer has an OMP account. The employer may ask OMP to correct, claim, or remove the listing by contacting careers@oncologymedicalphysics.com and providing reasonable proof of authority. OMP will review such requests promptly.

Review, moderation, reporting, and appeals

OMP may review, refuse, edit for formatting, label, limit distribution of, unpublish, or remove content that OMP reasonably believes violates these Terms, law, safety, third-party rights, or platform quality standards. OMP may preserve evidence and cooperate with lawful authorities. OMP is not obligated to monitor every listing or communication.

Report suspected scams, discrimination, illegal content, expired roles, impersonation, or other problems to careers@oncologymedicalphysics.com with the listing URL and supporting detail. Where applicable law requires it, OMP will provide the affected user a statement of reasons and access to a free internal complaint process. Appeals should identify the decision, explain the requested correction, and include relevant evidence.

Search order, recommendations, and paid prominence

OMP may order or recommend listings using factors such as query relevance, location, specialty, filters selected by the user, freshness, completeness, quality signals, and paid prominence. Paid or enhanced placements will be labeled, for example, "Sponsored" or "Featured." OMP may test or change ranking methods, but purchase does not guarantee traffic, applications, interviews, or hiring.

Employer use of applicant and résumé data

An employer that receives or accesses candidate data through the Services must:

  • Use the information only to evaluate the individual for genuine current or reasonably anticipated employment opportunities and related recruiting communications.
  • Provide any notice and obtain any consent required for the employer's own recruiting process, screening, background checks, automated tools, retention, or international transfers.
  • Not sell, rent, scrape, disclose for unrelated marketing, enrich unrelated profiles, train general-purpose artificial-intelligence models, or use the data for credit, insurance, healthcare, or other unrelated eligibility decisions.
  • Limit access to personnel and service providers with a recruitment need; apply reasonable administrative, technical, and physical safeguards; and delete or de-identify the information when no longer needed or when required by law.
  • Honor applicable candidate rights and promptly stop contacting a candidate who withdraws or objects, subject to lawful recordkeeping.
  • Notify OMP without undue delay after discovering unauthorized access to candidate data obtained through the Services and provide information reasonably needed for investigation and legally required notices.

Employers act as independent controllers or businesses for their own recruiting decisions and applicant records and are responsible for their compliance. These obligations survive account closure.

Prohibited conduct

You may not:

  • Use the Services for unlawful, fraudulent, deceptive, discriminatory, harassing, threatening, exploitative, or unsafe conduct.
  • Impersonate a person or organization; misrepresent authority, credentials, affiliation, location, or a job opportunity; or create accounts through false identities.
  • Scrape, harvest, index, copy, aggregate, resell, or build a competing database from listings, profiles, résumés, contact details, or other Service content without OMP's prior written permission.
  • Use bots or automated means to access the Services except through an interface OMP expressly provides; evade rate limits or access controls; probe for vulnerabilities; introduce malicious code; or interfere with operation.
  • Contact candidates for unrelated solicitation, mass marketing, financial schemes, identity verification payments, or requests for financial or government identifiers before a legitimate need and secure process exist.
  • Reverse engineer the Services, remove rights notices, or use OMP branding in a way that suggests endorsement without permission.

Fees, checkout terms, and taxes

Employer listing fees, package duration, included features, renewal interval, and any material restrictions will be shown before purchase. Those checkout disclosures are incorporated into these Terms. OMP may change future offerings and prices, but will not apply a new price to an already-paid term. The purchaser is responsible for applicable taxes, except taxes imposed on OMP's income.

Payments may be processed by Stripe or another identified payment provider. The provider's terms may apply to payment processing. OMP does not require or intend to store complete payment-card numbers on its own servers.

Automatic renewal

IMPORTANT - RECURRING CHARGES

A listing or package identified at checkout as automatically renewing will renew for successive periods of the same length shown at checkout until canceled. By completing that purchase, the employer authorizes OMP and its payment provider to charge the stored payment method at each renewal at the price disclosed for the renewal, plus applicable taxes. OMP will make the renewal terms conspicuous before purchase and provide any reminder or price-change notice required by applicable law.

The employer may cancel automatic renewal through available account controls or by emailing careers@oncologymedicalphysics.com before the renewal charge. Cancellation stops future renewals but does not shorten or refund the current paid term. OMP will provide a cancellation method that is at least as easy as the method used to enroll, where required by law, and will send confirmation after cancellation.

If a payment method fails, OMP may retry the charge, request an updated method, pause benefits, or allow the listing to expire. OMP will not represent a failed renewal as active when the paid term has ended.

Cancellations and refunds

An employer may request a full refund before the purchased listing is published. After publication, fees are generally nonrefundable because placement and review services begin immediately. OMP will, however, refund or correct a duplicate charge, an OMP billing or publication error, or a charge for a placement OMP is unable to deliver. Any refund required by mandatory law will also be honored.

For an automatically renewed listing, a request made before the renewed listing is republished is treated as a pre-publication cancellation. Removal for the employer's breach does not create a refund right. Refund requests must be sent to careers@oncologymedicalphysics.com with the account email, listing, charge date, and reason.

Ownership and content license

OMP and its licensors own the Services, software, design, compilations, and OMP-created content, subject to third-party rights and applicable law. These Terms do not transfer ownership to you. OMP grants you a limited, revocable, nonexclusive, nontransferable right to use the Services for their intended purpose during your compliance with these Terms.

You retain ownership of content you submit. You grant OMP a worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, adapt for display, distribute, and publicly display the content as needed to operate, secure, moderate, advertise, and improve the Services and the submitted listing. The license lasts while the content is on the Services and for reasonable backup, legal, and evidentiary periods. You represent that you have the rights needed to grant it.

Feedback may be used without restriction or compensation, provided OMP does not publicly identify you as its source without permission.

Copyright complaints

If you believe content on the Services infringes your copyright, send a notice to support@oncologymedicalphysics.com and Oncology Medical Physics LLC, 5013 S Louise Ave, Unit #7123, Sioux Falls, SD 57108. Include: identification of the copyrighted work; identification and location of the challenged material; your name and contact information; a good-faith statement that the use is not authorized; a statement under penalty of perjury that the notice is accurate and you are authorized to act; and a physical or electronic signature.

OMP may remove or restrict material and notify the submitter. A submitter may provide a legally sufficient counter-notice. OMP may terminate repeat infringers where appropriate. OMP will update this section with the exact designated-agent information after any U.S. Copyright Office registration becomes effective.

Privacy, cookies, and communications

The OMP Privacy Policy explains how OMP handles personal information. OMP may send service, security, billing, application, listing, and account messages needed to perform the Services. Marketing messages are handled separately, and recipients may unsubscribe using the message link or by contacting OMP. Unsubscribing from marketing does not stop essential service messages.

Where consent is required for nonessential cookies or similar technologies, OMP will ask before activating them. Cookie choices are available through the site's Cookie Settings control.

Third-party services and links

The Services may link to employer sites, payment providers, embedded content, or other third parties. OMP does not control and is not responsible for their content, availability, security, or privacy practices. A link does not imply endorsement. Use third-party services at your own risk and review their terms.

Suspension and termination

You may stop using the Services and close an account through available controls or by contacting OMP. OMP may suspend, restrict, or terminate access, with or without removing content, when reasonably necessary to address a material breach, fraud, nonpayment, security or legal risk, harm to others, platform discontinuation, or a lawful request. When practicable and appropriate, OMP will give notice and an opportunity to cure or appeal.

Sections that by nature should survive will survive, including payment obligations, content licenses needed for retained copies, candidate-data restrictions, ownership, disclaimers, limitations, indemnity, disputes, and general terms.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." OMP DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS. OMP DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT LISTINGS, USERS, LINKS, OR EMPLOYMENT OUTCOMES ARE RELIABLE.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded, including mandatory consumer rights.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMP AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, OR EMPLOYMENT; OR CONDUCT OF AN EMPLOYER, CANDIDATE, OR THIRD PARTY, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMP'S TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID OMP FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT OR (B) USD $100. For a job seeker who paid nothing, the USD $100 amount applies.

The limitations do not apply to liability that applicable law does not permit OMP to limit, including, where applicable, liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or violation of mandatory privacy or consumer rights. Some jurisdictions do not allow certain exclusions, so a limitation may apply only to the extent lawful.

Indemnity

To the extent permitted by law, an organization or person using the Services for business purposes will defend, indemnify, and hold harmless OMP and its personnel from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from that user's content, listing, recruitment conduct, use of candidate data, violation of law, or material breach of these Terms. OMP will provide reasonable notice and may control the defense. This section does not apply to an individual consumer to the extent prohibited by law.

Governing law and courts

South Dakota law governs these Terms, without regard to conflict-of-law rules. Subject to mandatory law, the state and federal courts located in Minnehaha County, South Dakota have exclusive jurisdiction, and each party consents to those courts. This clause does not deprive a consumer of nonwaivable protections or the right to bring a claim in another forum that mandatory law requires. These Terms do not require arbitration and do not waive a right to a jury trial.

Changes to the Terms

OMP may update these Terms to reflect changes in the Services, law, or risk. OMP will post the revised Terms and update the effective date. If a change materially affects an existing account or recurring purchase, OMP will provide additional notice and obtain consent when required. Changes apply prospectively unless law permits otherwise. Continued use after the effective date constitutes acceptance only to the extent permitted by law.

General terms

These Terms, the Privacy Policy, and incorporated checkout or feature terms are the entire agreement concerning the Services. If a provision is unenforceable, it will be modified to the minimum extent necessary and the rest remains effective. Failure to enforce is not a waiver. You may not assign these Terms without OMP's written consent; OMP may assign them in connection with a reorganization, financing, merger, sale, or transfer of the Services, subject to applicable law. Headings are for convenience. Electronic notices and records satisfy writing requirements where lawful. OMP is not liable for delay caused by events beyond reasonable control.
